1. Acceptance of These Terms

By accessing or using the Site, you agree to be bound by these Terms and by any laws and regulations that apply to your use of it. If you do not agree with these Terms, please do not use the Site.

These Terms apply to every visitor to the Site. We may update them from time to time as described in the "Changes to These Terms" section below, and your continued use of the Site after we post an update means you accept the updated Terms.

2. Who May Use This Website (Age Requirement)

The Site is intended only for adults who are 21 years of age or older. Cannabis and cannabis-related content are restricted to adults 21+, and the Site is not directed to, and is not intended for, anyone under 21.

When you confirm your age, the Site saves a single functional entry in your browser (see our Privacy Policy) so that it does not have to ask again on every visit. The Site is provided for general informational purposes only. It describes our store, product categories, staff picks, educational content, partner brands, and the areas we serve. It does not display prices, and it is not a store.

You cannot buy anything, add anything to a cart, place an order, or check out on the Site. No purchase or transaction of any kind takes place here.

If you choose to order online, that ordering happens on a separate, third-party platform located at shop.bestbudznj.com/saddle-brook. That platform is operated under its own terms of service and privacy policy, and any order you place, along with its pricing, payment, and fulfillment, is governed by that platform and applicable law — not by these Terms. We are not responsible for that platform's content, availability, or practices. In-store purchases at our Saddle Brook location are handled at the store and are subject to New Jersey law and our store policies, not these Terms.

4. No Medical, Health, or Legal Advice

The content on the Site, including any educational material, product descriptions, or staff picks, is for general information only. It is not medical, health, or legal advice, and it is not a substitute for advice from a qualified professional.

We make no medical or health claims about cannabis or any product. Cannabis has not been evaluated or approved by the U.S. Food and Drug Administration for the diagnosis, cure, mitigation, treatment, or prevention of any disease or condition. Individual effects vary from person to person.

Do not rely on the Site to make medical, health, or legal decisions. If you have questions about your health or how cannabis may affect you, consult a licensed physician or other qualified professional.

5. Product Categories, Availability, and Descriptions

Any product categories, brands, staff picks, or descriptions shown on the Site are provided for general information and are illustrative only. They are not an offer to sell and do not guarantee that any item is in stock or available.

Cannabis inventory changes constantly. Products, brands, categories, availability, and descriptions may change at any time without notice, and information on the Site may be incomplete, out of date, or contain errors.

We do not warrant that any information on the Site is accurate, current, or complete, and we are not obligated to update it. For current availability, please contact the store or check the separate ordering platform.

6. Promotions, Discounts, and the Rewards Program

The Site describes promotions and a rewards program — for example a discount on a first online order, loyalty points earned on purchases, and discounts for first responders, educators, veterans, industry workers, and seniors. These descriptions are summaries provided for general information only.

Every offer is run through our store or through our separate online-ordering platform, not on this Site. You cannot redeem an offer, enroll in the rewards program, or earn or spend points here.

Offers may be changed, limited, suspended, or withdrawn at any time without notice. Unless an offer states otherwise, offers cannot be combined with one another, are limited to one use per customer, and require a valid government-issued photo ID showing that you are 21 or older. Discounts for first responders, educators, veterans, industry workers, and seniors require acceptable proof of eligibility at the counter.

If the description of an offer on this Site ever conflicts with that offer's own terms at the store or on the ordering platform, those terms govern.

7. Intellectual Property and Limited License

The Site and its content — including text, graphics, logos, layout, photographs, and other materials, together with the "Best Budz NJ" name and our logos and branding — are owned by us or our licensors and are protected by intellectual property and other laws.

Third-party brand names, product names, and logos that appear on the Site (including those of our partner brands) belong to their respective owners. Their appearance on the Site does not imply any endorsement of us by those owners, and we claim no ownership of their marks.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site for your own, non-commercial, informational use. You may not do any of the following without our prior written permission:

• Copy, reproduce, republish, distribute, sell, or otherwise exploit any part of the Site or its content.
• Use automated tools to scrape, crawl, harvest, or index the Site or its content, or otherwise collect data from it in bulk.
• Modify, create derivative works from, frame, or mirror any part of the Site.
• Use our name, logos, or branding, or any third-party marks shown on the Site, in a way that suggests affiliation or endorsement.

The Site contains links to third-party websites and services, including the separate online-ordering platform, partner-brand sites, and any social media pages we may link to. Some pages on the Site — our home page and our "Areas We Serve" landing pages — also embed a Google map, which loads content directly from Google when you view those pages.

We provide these links and embedded features for convenience only. We do not control third-party sites or services, we do not endorse them by linking to them, and we are not responsible for their content, products, availability, privacy practices, or terms.

When you follow a link to a third-party site or interact with embedded third-party content, you do so at your own risk and are subject to that third party's own terms and privacy policy.

9. Cannabis Responsibility and Compliance

Cannabis is for use only by adults 21 and older and only where permitted by New Jersey law. By using the Site, you agree to use cannabis products responsibly and in compliance with all applicable laws. In particular:

• Keep cannabis products out of the reach of children and pets.
• Do not drive, operate machinery, or perform other activities that require full attention while under the influence of cannabis.
• Effects vary from person to person and may be delayed; start low and go slow, and consume responsibly.
• Do not use cannabis if doing so is unlawful for you, and comply with all applicable New Jersey laws and regulations.

10. "As Is" — No Warranties

The Site and all of its content are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any information on it is accurate, current, or complete. You use the Site at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, in no event will the Company or its owners, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Site — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US $100.00).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless the Company and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.

You agree that the state and federal courts located in New Jersey will have exclusive jurisdiction over any such dispute, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date shown above and post the updated Terms on the Site. Any changes take effect when we post them.

It is your responsibility to review these Terms periodically. Your continued use of the Site after an update means you accept the revised Terms.
